A class action is a legal proceeding commenced by one or more "representative" persons on behalf of a small or large group of other persons with similar interests.
Class actions are appropriate in the employment area, because, in many cases, the cost of litigation to individual employees effectively prohibits them from pursuing a fair settlement of their benefits, pension or dismissal rights, especially when the employer is a large and powerful corporation. Individuals with good claims may find it too expensive or too complicated and stressful to act alone.
Legislation in British Columbia recognizes this inequality and facilitates class actions where common legal issues face groups of people, even if recovery amounts will vary with the individual. One person claims as a representative of a class of financially injured persons, be they laid off employees, pensioners, disabled workers or even shareholders or residents of a certain community.
With class actions, individuals enjoy access to justice where they might otherwise have to give up. This is accomplished by banding together in a group, with assistance of qualified legal counsel, and with the approval and supervision of the Supreme Court of British Columbia.
